An Act to amend the criminal procedure law, in relation to providing witnesses with facility dogs 

{Name of organization} is submitting this memorandum in support of the passage of Rosie�s Law (S.4865/A.7159).

The Children�s Home of Poughkeepsie was founded in 1847, to serve orphans and homeless children and over the years has developed services to treat at-risk youth who have suffered multiple adverse childhood events including in many instances abuse, trauma, and neglect. Rosie the dog for whom this law is named accompanied

Rosie�s Law provides judges with the discretion to allow certain witnesses from either the prosecution or the defense the ability to testify with the aid of a facility dog to ensure fair and accurate testimony. Currently, courthouse dogs may be used to aid a child during testimony. This law extends that use to adult victims or witnesses of violent crimes or sexual assault as well as those who are physically or emotionally impaired.

The criminal justice process is confusing and intimidating to most people. Victims who have experienced interpersonal violence are often overwhelmed as the trauma of their victimization can be triggered in court settings, particularly because of their offender�s presence. The presence of a courtroom dog will ease the emotional distress heightened by the courtroom experience which can hamper the ability of a witness to provide meaningful testimony.

Rosie�s Law would provide for the emotional support and psychological support necessary for victims and witnesses testifying in these cases.
